Chapter 11 : Police Service

(1) |
The national police service must be
structured to function in the national, provincial and,
where appropriate, local spheres of government. |

(2) |
National legislation must establish the
powers and functions of the police service and must enable
the police service to discharge its responsibilities
effectively, taking into account the requirements of the
provinces. |

The objects of the police service are to
prevent, combat and investigate crime, to maintain public
order, to protect and secure the inhabitants of the
Republic and their property, and to uphold and enforce the
law |
Functions : Secretariat for Department of Police
South African Police Service Act, No 68 of 1995
Section 3 Functions : Secretariat
- advise the Minister in the exercise of his or her powers
and the performance of his or her duties and functions;
- perform such functions as the Minister may consider
necessary or expedient to ensure civilian oversight of the
Service;
- promote democratic accountability and transparency in the
Service;
- promote and facilitate participation by the Service in the
Reconstruction and Development Programme;
- provide the Minister with legal services and advice on
constitutional matters;
- provide the Minister with communication, support and
administrative services;
- monitor the implementation of policy and directions issued
by the Minister and report to the Minister thereon;
- conduct research into any policing matter in accordance
with the instructions of the Minister and report to the
Minister thereon;
- perform such functions as may from time to time be
assigned to the secretariat by the Minister; and
- evaluate the functioning of the Service and report to the
Minister thereon.

Consists of:

- Department of Police
- Executive Director : ICD
Purpose:
- Develop, maintain & evaluate policy in accordance with
policing needs and priorities of Government
- Formalize political direction
- Co-ordinate operational and supportive functioning of the
various components of the Department
Executive Co-ordinating Committee (ECC)
Consists of:
- Minister of Police
- Deputy Minister of Police
- Members of the Executive Councils responsible for Safety &
Security at Provincial level
- National Commissioner : SAPS
- Department of Police
- Executive Director : ICD
Purpose:
To ensure effective co-ordination of the Police Service and
effective cooperation among spheres of Government (Sec 206[8] -
Police Service Act)
Management Forum : South African
Police Service (Board of Commissioners)
Consists of:
- National Commissioner
- Deputy National Commissioners
- Divisional Commissioners
- Provincial Commissioners
Purpose:
To promote operational co-operation and co-ordination in the
Service (Sec 10 - Police Service Act)
