FOUR ACCUSED FOUND GUILTY OF THEFT OF ESSENTIAL INFRASTRUCTURE AND SENTENCED TO DIRECT IMPRISONMENT: BEKKERSDAL

On the 28th of April 2021 the Westonaria regional court sentenced four accused all from Mohlakeng near Randfontein after they were found guilty of theft of essential infrastructure and for being a foreigner in terms of Section 41 of the immigrations Act ( Act 13 of 2002)  that was committed on the 28th of October 2020 at approximately 03:50 am in Zuurbekom.

The members were allegedly patrolling along the railway street in Zuurbekom when they spotted a truck with a group of males at the back of the truck.  The members approached the truck with a blue light on intending to stop and as they were driving towards the truck, they noticed the occupants jumping from the moving truck into the open veld.

The members managed to corner and arrest four males from the group and upon investigating the contents inside the truck, the members found thirty six(36) pieces of railway trails, rings of enforcement, gas and compressed oxygen bottles suspected of being used to cutoff the railway trails were also seized from the truck.  All four suspects were arrested and charged with theft of essential infrastructure and for being illegal in the country and they were since denied bail.

The sentences were passed as follows:

 *Accused no 1* 

26 year old  Raymond Hlungwane was sentenced to 4 years imprisonment for count 1 and 30 days imprisonment  and deportation after release to be considered, for count 2,

 *Accused 2* 

27 year old

Sam was sentenced to 5 years imprisonment  for count 1 and 30 days imprisonment and  deportation after release to be considered for count 2,

*Accuse 3* 

26 year old Obert Chauke was sentenced to 4 years imprisonment for count 1 and 30 days imprisonment  and deportation after release to be considered for count 2 and-

 *Accuse 4* 

A 29-year-old Shishange Luwig was sentenced to 4 years imprisonment for count 1 and also 30 days imprisonment and deportation after release to be considered for count 2.

Theft of essential infrastructure specifically railway trails around  Simunye and Zuurbekom left commuters stranded after they were removed and stolen by criminals which they later sell for their personal gain. We strongly condemn this kind of criminal behavior. We are also making a strong warning to the second hands dealership to refrain from creating markets for stolen properties and rather work hand in hand with the police by immediately reporting such conducts to the police. It is an offence punishable by law to be found in possession of stolen goods, to be dealing in stolen goods and to buy  stolen goods therefore this sentence must serve as a deterrent to would be criminals  that crime does not pay said the Colonel Phumelele

Matamela as she commended the members for the arrest, and for the conviction. She further extended her gratitude to the prosecuting team for finalizing this matter with a jail term sentence.
