MULTI-MILLION ESTATE AGENT FRAUDSTER SENTENCED: EASTERN CAPE

EASTERN CAPE: The Provincial Head Major General Obed Ngwenya applauded the Gqeberha based Serious Commercial Crime Investigation team of the Hawks for their thorough investigation that ensured that the Gqeberha Specialised Commercial Crime Court sentenced Nondumiso Olivia David (55) on 19 July 2023 on charges of fraud and contravention of Section 26(1) Act 12 of 1976 for carrying on a business as an estate agent without a valid Fidelity Fund Certificate, whilst the case against Vusumzi David (53) who is the co-accused is still pending.  

During the period of 1 January 2018 until 30 October 2018, the accused persons Vusumzi David (53) and his wife Nondumiso David as Estate Agents for Zolam Properties defrauded six (6) victims in Gqeberha area out of purchase of houses to the total value of over R5 million. The accused made their six (6) clients to believe that BNI Attorneys were conducting the conveyance of the properties, however the monies were deposited into the business account of both accused persons.

After several court appearances Nondumiso David was sentenced to thirty six (36) months correctional supervision in terms of Section 276(1) plus two (2) years imprisonment, suspended for five (5) years. Furthermore, charges against Vusumzi are at the edge of being withdrawn should Nondumiso pay back the monies to her victims on before 30 July 2023.
