Ladysmith FCS Unit members secure harsh convictions

Members from the Ladysmith Family Violence, Child Protection and Sexual Offences Unit (FCS) recently showed what their hard work can achieve. Five of the investigating officers attached to the unit recorded good convictions.

Constable Sabelo Ntshingila was given an Ekuvukeni case of rape to solve. The case related to an incident which happened on 8 July 2010 in Limehill, Ekuvukeni. A fifteen year old neighbour was playing outside with an eleven year old boy. The teenager then suddenly stopped playing with the child and dragged him into a nearby house. He locked the child inside and then raped him. The child was later allowed to leave. The child reported the incident to his parents after which it was reported to the police. The teenager was arrested and was then released into the custody of his guardian. Two years later, on 23 April 2012, the teenager was again playing with a seven year old child when he attacked and raped the boy. The suspect was arrested. On 28 March 2014 the teenager was sentenced in the Dundee Regional Court to 6 years imprisonment on each count of rape (a total of 12 years). He was declared unfit to possess a firearm and his details are to be placed on the Register for Sexual Offenders. The family of both the children indicated to the investigating officer that they were pleased with the sentences meted out to the accused.

Investigating officer, Constable Gerald Juggiah, was dealing with a rape case which happened on 18 February 2014 at about 09:00 in the Burford area of Ladysmith. An eight year old girl was at home with her aunt when her 23 year old father suddenly arrived at the house and took her away with him. Later the mother of the child and the aunt went to fetch the child back. The child then confided in them that the father had raped her. The matter was reported to police and the father was subsequently arrested. He remained in custody until he was sentenced in the Ladysmith Regional Court on 25 March 2014 to 15 years imprisonment for rape. He was also declared unfit to possess a firearm and his details are to be placed on the Register for Sexual Offenders.

Two FCS detectives, Constable Lungisani Ntsele and Warrant Officer Nhlanhla Mncwango worked on an Ekuvukeni case of rape which happened on 8 November 2007 in the Tholene Area of Ekuvukeni. In this case a 9 year old child was getting ready for school when a 24 year old resident of the area entered the house and raped her. The child reported the incident to relatives and police were called in. The following day Mandla Isaac Xaba was arrested for the incident. On 25 March 2014 the Dundee Regional Court sentenced the accused to 25 years imprisonment for rape. He was declared unfit to possess a firearm and his details are to be placed on the Register for Sexual Offenders.

Warrant Officer John Masengemi was successful in gaining convictions in two of his cases. In a Ladysmith case which happened in the Watersmeet area on 29 June 2012 at about 20:00, a teenager was asked by a neighbour to help him carry groceries into the house. Once inside the house he grabbed the 15 year old teenager and raped her. She reported the matter to her family as well as to police. The suspect Dumisani Ngwenya aged 25 was arrested and was later sentenced on 20 February 2014 to 14 years imprisonment by the Ladysmith Regional Court. In the second case which happened on 17 January 2014 at 14:00 a 44 year old man entered a shop in Kandahar Avenue, Ladysmith where he proceeded to undress himself and masturbate. Police were called and the man was arrested. On 31 March 2014 Dumisani Ntshangase was sentenced by the Ladysmith Magistrates Court to 12 months imprisonment for Indecent Exposure.

KwaZulu-Natal Provincial Commissioner, Lieutenant General Mmamonnye Ngobeni commended the outstanding work done by Family Violence, Child Protection and Sexual Offences Units in the Province. 'We will continue protecting our women and children against the abusers and we will arrest those abusers and send them to jail. We appeal to the victims of rape to report such abuse and they must not be intimidated by the abusers,' she said.
